Terms and Conditions - "The Vyapaar Challenge"

  1. Introduction

Welcome to ‘The Vyapaar Challenge!’ This competition offers college students an opportunity to sell maximum Bingebars with an opportunity to earn profits and showcase their entrepreneurial skills and marketing prowess.

By participating, you agree to adhere to the following terms and conditions: 

  1. Eligibility
  1. The Vyapaar Challenge is open to students pursuing Undergraduate/Postgraduate Degree Courses within the age range of 18 - 25. 
  2. By entering the competition, you represent and warrant that you have the legal capacity to enter into a binding agreement and that you comply with these terms and conditions.

  1. Participant Registration
  • Participants must register through the online form provided at www.chitalebandhu.in 
  • Participants must pre-book a minimum of 5 BingeBar Boxes to confirm their registration. 
  • All communication regarding the challenge will be conducted through the designated WhatsApp group of the respective location cluster.
  • The competition will run from [Insert Date] to [Insert Date]. 

  1. Registration Deadline
  • The registration window closes on [Insert Date] at [Insert Time] IST.
  • Registrations received after the specified deadline will not be considered.

  1. Disqualification Criteria

Participants will be disqualified if found engaging in cheating, unethical practices, or violation of the competition rules. Detailed competition rules would be shared after participation and violation of them and misconduct can also be considered under disqualification. The decision of the organizing committee in such matters shall be final.

  1. Judging Criteria and Prize
  1. The judging criteria for the Vyapaar challenge, including the evaluation of sales performance, marketing strategies, cluster performance, and college participation, are subject to final decision and potential modification by Chitale Bandhu Mithaiwale.
  2. Chitale Bandhu Mithaiwale retains the authority to determine the winners, allocate prizes, and disqualify participants who breach competition rules, with their decisions being conclusive and binding.
  3. The Prize is non-transferable and non-exchangeable.
  4. The prize-winners acknowledge that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.

  1. Confidential Information

The term "Confidential Information" shall mean any non-public, confidential, and sensitive information pertaining to the financial, business, or technological aspects of the Organization. This includes trade secrets, business plans, financial records, proprietary technology, product details, manufacturing processes, patents, client information, marketing strategies, intellectual property rights, and any other information considered confidential by the Organization. Such information may be communicated in various forms (graphic, oral, electronic, or written) to the party specified in the agreement, either before or after the agreement's date, regardless of whether it was labeled as confidential at the time of disclosure.

  1. 8. Confidentiality  

 Any Confidential Information shall be held in strict confidence and shall not be distributed, disclosed, or disseminated in any way or form by the Participant to maintain its confidentiality.

  1. Intellectual Property Rights

Intellectual Property Rights shall mean and include tangible and intangible legal rights and interests owned by the Organization. This includes inventions, patents (both pending and granted), trademarks, copyrights, trade secrets, proprietary processes, and formulae, as well as licenses, government authorizations, and other proprietary rights. CBM shall have the exclusive interest in and the ownership of its Intellectual Property Rights.

  1. Non-Disparagement

The Participant shall not at any time make statements or representations or otherwise communicate directly or indirectly in writing, orally or otherwise or take any action which may directly or indirectly disparage, defame or insult CBM or any of it’s goods or affiliates or any employees.

  1. 11. Return of the Products

The Participants shall return all products, property of, or relating to the Chitale Bandhu Mithaiwale (“CBM”) as shall have been in the possession of the Participant, including the CBM’s records and all documents and Confidential Information, to an authorised representative of the CBM after the competition is over. If the Participants fail to do so, CBM shall take such steps as may be appropriate, to recover the damages from the Participant.

  1. Indemnity 

Participants agree to indemnify and hold the organizing committee, its affiliates, and representatives harmless from any claims, damages, or liabilities arising out of their participation in the challenge or any breach of these terms and conditions.

  1. Modifications and Cancellation

The organizing committee reserves the right to modify, extend, or cancel ‘The Vyapaar Challenge’ at any time, for any reason, without prior notice.

  1. Privacy Policy:
  1. The Participant’s personal details such as their name, telephone number, postal address and email address provided shall be used for the process of self-registration on the website, and it shall be considered that the Participant has voluntarily given the personal information. 
  2. The Participant's data collected during registration will be kept confidential. The Participant information will be used solely for the purpose of organizing and managing ‘The Vyapaar Challenge’ and keeping them updated on the latest updates related to the competition. 

  1. General Clauses
  1. The Participants may be subject to additional rules. If so, these additional rules will be listed on the relevant competition entry page and form part of this agreement. 
  2. By registration on entry to the competition, the Participants indicate that they have accepted these Terms and Conditions.
  3. CBM shall not be liable for any malfunction or event beyond our reasonable control which prevents entry to the competition or fulfilment of the prize. By participating in the competition the Participants agree to this condition.
  4. The Participants agree to release and hold harmless CBM from any and all liability, claims, or damages arising out of their participation in the competition.
  5. If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

  1. Governing Law and Jurisdiction:

These terms and conditions shall be governed by and construed in accordance with the laws of Pune, Maharashtra in India. Any disputes arising from or in connection with the challenge shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra in India. 

By participating in ‘The Vyapaar Challenge’, you signify your acceptance of these terms and conditions. We look forward to your entrepreneurial journey!
